Bobby’s Law is about to become Montana’s Law, creating a new category for drunk driving: Aggravated DUI. House Bill 267, carried by Rep. Braxton Mitchell, a Republican from Columbia Falls, honors the memory of Bobby Dewbre, who was killed by a drunk driver in Columbia Falls in 2023.
Under HB 267, if a driver kills someone while registering a blood alcohol content of 0.16 or higher, twice the legal limit, they would be charged with aggravated vehicular homicide. That comes with a prison sentence of up to 30-years and as much as a $50,000 fine.
Dewbre’s father, Robert Dewbre, tells Legislators, “I cannot bring Bob back, but Bobby’s Law would mitigate these deaths, hopefully by providing an effective deterrent. But at the very least, taking these drivers unwilling to change off the streets.”
Gov. Greg Gianforte is expected to sign Bobby’s Law into effect in the next few days.
