It’s been said that 20% of the US population moves to another city or state each year. How many people know if they’re registered to vote in the state from which they came? When we register to vote in Montana, it doesn’t mean that your prior state registration in automatically deleted. That could have put you in trouble with the law in Montana. House Bill 892 from the 2023 Legislature made it a crime to be registered in another place. That’s not going to happen with an agreement worked out by the Secretary of State and the Commission of Political Practices.
Turns out that, according to Federal Judge Brian Morris, double voting is a crime in Montana and double registration, as in House Bill 892, is unconstitutional.
And so, even if you’re still registered to vote in another jurisdiction or state, you’re safe from prosecution as long as you don’t vote twice. That law stands in Montana.
