Last month, Citizens for a Better Flathead sued the County Commissioners over the length of a dock into Flathead Lake at Lakeside. Now, the same organization has filed another suit–this time over construction of a home on Whitefish Lake. In both cases, they cite the state’s Lakeshore Protection and the Public Participation in Government Acts.
The latest, involves construction of a home on Beaver Bay in Whitefish Lake. Apparently, blasting on the property a couple of years ago propelled debris into the lake. That stopped the project for an investigation by the County. A year before that, construction halted when trees were removed without a permit.
County planners say the construction is in compliance with County and State regulations. Citizens for a Better Flathead has filed several appeals, which were denied. That, they say, is in violation to their constitutional right to participate in government.
Their latest lawsuit is asking that the property be restored to its original condition.
