At Monday night’s Kalispell City Council Meeting, there was much discussion on the proposed Ordinance 1948, which would make it possible for the City to revoke at Conditional Use Permit. The Council voted, on first-reading, in favor of the changes. Council member and Mayor-Elect Ryan Hunter voted against the ordinance, as did Jessica Dahlman. Kari Gabriel was absent.
It was made clear that all C-U-P’s now in force, would not be effected by the new ordinance, if eventually passed. Some thought it could be used as retribution for the lawsuit in Federal Court by the Warming Center when the Council voted to revoke their Permit.
City Planner Donnie McBath explained that the new ordinance would provide clarity and structure to the process of revocation and that the decision would require a vote of the City Council, but the last word would rest with the Courts.
Since the First Reading wasn’t a unanimous vote, a second reading will be scheduled in an upcoming City Council meeting.
