Last week, the Montana Supreme Court dismissed the complaint against Attorney General Austin Knudsen, rejecting the recommendation of the State Commission on Practice. It wasn’t exactly an exoneration for Knudsen, but it is likely the end of the complaint that could have suspended his license to practice law for 90-days.
What made this case so intense is that it involved sitting members of the Supreme Court. Those justices recused themselves, leaving only Chief Justice Cory Swanson and Justice Katherine Bidegaray, since they weren’t on the bench when the actions were brought into question. Five sitting District Court Judges were asked to hear the case in their place.
