40-year old Kenneth James Floyd (pictured) is trying every legal means to stay out of prison for his conviction of running-over his wife, 37-year old Kimberly Ann Gilham of Martin City back in June of 2023.
It took 6-hours of deliberation for the jury to find Floyd guilty. Then, he asked that Judge Dan Wilson be removed from the case, his conviction quashed and he be given a new trial. This, after the Montana Supreme Court denied Floyd’s request to disqualify Judge Wilson from the case.
The latest legal move was asking Judge Wilson to nullify the verdict and have a new trial. He argued there wasn’t sufficient evidence to support the guilty verdict. Judge Wilson disagreed.
During the trial, the most-damning evidence was the video showing the whole episode. The video shows Kimberly sitting in a pickup truck with Floyd. The video shows Kimberly’s current husband, Chris Gilham, approaching the Chevy Silverado, starting an argument. We’re told Kimberly got out of the truck and moments later, Floyd drove the truck forward, striking her. He then drove away.
Special Deputy County Attorney Eric Kitzmiller and Assistant Attorney General Edward Hirsch prosecuted the case…both on-loan from the state. Flathead County Attorney Travis Ahner requested the help citing staff shortages.
