Helena District Court Judge Michael McMahon has place a stay on granting the water permit for the 1700-acre Flathead Lake Club, on Blacktail Mountain.
The non-profit Citizens for a Better Flathead and Lakeside resident Bruce Young–a recent guest on the KGEZ Good Morning Show, claim they weren’t allowed comments when DNRC approved the permit. The Judge ruled that the DNRC decision’s decision was unilateral and, in his words, “to forever muzzle petitioners’ public comments and objections.”
He says a stay will allow more time for everyone to be heard on the matter. During the stay, he’s ordered those state employees involved with the process to appear before the court to explain the basis of their decision.
The case is also being moved to Flathead District Court.
The Flathead Lake Club would be Discovery Land Company’s 4th members-only community in Montana…including Crazy Mountain Ranch in Shields Valley, the Iron Horse Golf Club in Whitefish and the Yellowstone Club in Big Sky. The plan for the Flathead Lake Club includes a golf course, restaurants, a spa and fitness center and 359 homes.
They say they’ll execute their plan in 5-phases, the first for 59-residences and 7-commercial lots. Included is a private 36-boat marina, which is planned to replace the old Hockaday Orchards. And then there’s the matter of the private airstrip, for personal jets.
