It sounds a lot worse than it is. The Flathead County Commissioner have approved, unanimously, an extension for a permit to build that controversial dock into Flathead Lake at Lakeside. This should not be confused with a permit to start construction.
District Judge Dan Wilson has granted Citizens for a Better Flathead an injunction, temporarily over-turning the Commissioners approval of the variance. That variance was to expire on April 24th.
Judge Wilson’s injunction cites the requirements of the Montana Lakeshore Protection Act and the Public Participation in Government Act. The variance sought by the Discover Land Company, out of Arizona, was to extend the dock an additional 59-feet beyond the 100-foot statutory distance from shoreline.
The variance sought by the developer was to extend the dock an additional 59-feet beyond the 100-foot statutory distance from shoreline.
Keep in mind that the Commissioner’s extending the permit doesn’t mean construction can continue. That rests with the results of the lawsuit brought by Citizens For A Better Flathead.
